40 gallon tank?

I was given a 40 gallon tank as a gift as a start up for getting an axie! I have been reading that a ten gallon tank is sufficient for one because they swim up to the top for air and it would seem that 40 gallons is a long swim. Can I still use this tank and just not fill the water up so high, granted the filter can reach the lower water level? Is 40 gallons actually ok?

What are the dimensions of the tank?

You should be fine filling the tank only partially, you just have to keep in mind how many gallons you're actually filling it and don't overburden the tank with too many axxies (it may be a 40 gallon, but if you only fill it halfway you only have 20 gallons of water).

I was going to do that with my 20-gallon but ended up filling it up to the top to accommodate my filter which was too high, so it depends on the type of filter as well. Internal or sponge filters should be fine which HOB filters without some extensions might not reach the water level (my initial problem) and will cause quite a current with how far the water would have to fall, so just a few things to keep in mind.

I don't have personal experience yet with how much or little axxies care to swim great distances to the top (I'm still very very slowly cycling my tank), but it may not be a problem to fill it up to the top.
 
Axies cant live comfortably in a 10 gallon, it is reccomended for one axie you should have a 20 gallon.
When mine were little i filled the tank half way, then as they grew i added more water, i think i read somewhere that axies only really need the water level a little higher than their length.
I only have a 3ft tank but my axies have to swim 3 times their length to reach the top.
I think it was kaysie who reminded me when i posted a similar thread, that in the wild they live in a lake, not shallow water, so they should be okay :)
 
They'll be fine with it filled all the way. I keep newborn axolotls in 40 gallon aquariums filled to the top.
